TERMS AND CONDITIONS FOR BOOKING SERVICES WITH AKAMPA, S.A. DE C.V.

Thank you for booking with AKAMPA, S.A. DE C.V. (hereinafter “AKAMPA”)!
By clicking the “Book” button or making a reservation through any of the available methods, and by making a deposit of any amount and/or for any purpose related to the services provided by AKAMPA, as the Customer (hereinafter “THE CUSTOMER”), you or the person you represent are bound by and accept these terms and conditions, including the cancellation policy, the privacy policy, and the data processing carried out by AKAMPA through the akampa.mx website.
NATURE OF THE SERVICES
By using the AKAMPA website or any of the communication channels that AKAMPA makes available to the CUSTOMER, the CUSTOMER acknowledges and agrees that the services provided by AKAMPA include, but are not exclusively limited to, the offering, organization, and provision of ecotourism services and recreational activities provided through third parties with whom AKAMPA maintains a business relationship for the purpose of providing the service.
AKAMPA’S MISSION
AKAMPA aims to facilitate THE CLIENT’s connection with nature through the provision of ecotourism services via third parties, assisting in the publication and promotion of expeditions specifically designed so that these expeditions comprise a trip planned in its entirety or for the most part. These expeditions are conducted in compliance with applicable local and federal laws and regulations.
CUSTOMER WARRANTIES
As a condition of requesting a reservation for an expedition, THE CUSTOMER warrants that:
Is at least 18 years of age and, if traveling with minors, has full legal guardianship over them, acting as their legal representative in the event of any type of strict civil liability, and is jointly and severally liable for any damages caused in accordance with the Federal Civil Code.
You have the legal authority to create a binding legal obligation.
You will complete the reservation process in accordance with this Agreement.
You will only use the established communication channels to make legitimate reservations for yourself or another person whom you have the legal authority to represent.
All information provided by you is true, accurate, current, and complete.
You have informed or will inform the people traveling with you of the content of these terms, including the risks involved in carrying out the intended activities.
The insurance information you have provided regarding your coverage is true, accurate, complete, and up-to-date.
By booking an expedition, you agree to pay at that time and to make a payment and, eventually, all charges to complete the total cost of the reservation, including the price of the expedition, applicable fees, offline fees, taxes, and other items identified during the payment process that form part of the total price of the expedition as published and offered.
Upon receiving confirmation of the expedition, THE CUSTOMER enters into a contract to receive the services offered. The reservation constitutes a limited license to enter, occupy, and use the lodging provided by third parties through AKAMPA, as well as the amenities and products provided by them to carry out the activities that are part of the expedition; at no time does this affect the exclusive ownership rights that third parties or AKAMPA hold over these items.
AKAMPA reserves the right to require the customer to vacate the property or land in accordance with applicable law, including with the assistance of law enforcement, should THE CUSTOMER extend their agreed-upon stay. THE CUSTOMER agrees to indemnify and hold harmless AKAMPA and any of its members from any claims that may arise from THE CUSTOMER’s negligence or recklessness.
THE CUSTOMER may not arrive with additional people beyond those who booked the expedition; in such a case, THE CUSTOMER grants AKAMPA the right to refuse expedition services to THE CUSTOMER if they bring third parties not included in the reservation, without the right to any refund.
LIABILITY
AKAMPA is not liable for any risk or damage suffered by THE CLIENT while receiving expedition services. THE CUSTOMER is responsible for complying with all instructions and agrees to act with care and diligence to prevent any damage while participating in the expedition and shall be liable for any damage caused by willful misconduct or negligence.
THE CUSTOMER acknowledges and accepts that many activities involve inherent risks and agrees that, to the extent permitted by applicable law, THE CUSTOMER assumes all risks arising from their participation in AKAMPA tours, including their participation in any expedition and any other interactions they have with other members, whether in person or online. This means that THE CUSTOMER is responsible for evaluating an expedition to determine whether it is suitable for them. For example, the services provided, by their very nature, may involve a risk of illness, bodily injury, disability, or death, and THE CLIENT freely and voluntarily assumes these risks by choosing to participate in the expeditions they book.
THE CUSTOMER is aware that the activities they may undertake as part of the services provided by AKAMPA are subject to unforeseen circumstances beyond AKAMPA’s control arising from nature itself and weather conditions; therefore, AKAMPA shall not be liable in any way should due to a situation beyond its control, including but not limited to any instance in which the flora, fauna, minerals, terrain, bodies of water, or other features cannot be seen and/or enjoyed, the activity cannot be provided in its entirety as advertised. This is understood on the condition that AKAMPA will do everything within its power to ensure that said activity can be carried out as advertised, within the applicable legal framework.
AKAMPA has full discretionary authority to determine that activities will not take place, either temporarily or entirely, due to a possible weather-related contingency that prevents their completion. In such a case, efforts will be made to carry out the activities to the extent possible or to replace them with activities that can be conducted at that time, without any obligation to refund the amounts paid by THE CUSTOMER to AKAMPA.
THE CLIENT is responsible for confirming that they and anyone under their supervision meet the minimum age, competence, physical condition, or other requirements established for participating in the activities. THE CUSTOMER is responsible for informing AKAMPA of any medical, physical, or other condition that may affect their ability to participate in, attend, or take part in the expedition being offered.
PAYMENT, CANCELLATION, AND REFUND POLICY
By making a reservation with a deposit, THE CUSTOMER agrees that they have the legal capacity to enter into a binding agreement and to pay the full amount for the expedition so that it is reserved and confirmed. THE CUSTOMER understands and agrees that the rates and prices offered may be subject to changes determined unilaterally by AKAMPA.
AKAMPA charges the amounts corresponding to the total price of the offered expedition directly through the payment method selected by THE CUSTOMER and receives the advance payment into the account designated for that purpose, in order to organize the expedition. This is on the understanding that AKAMPA makes payments to third parties in advance, contingent upon and independent of each trip, and that these terms may vary for each CUSTOMER; this implies that THE CUSTOMER shall not be entitled to a refund of the full amount of their payment at any time they may request it. Until the full amount of the agreed-upon consideration has been paid, the amount disbursed will be considered an advance payment, which must be supplemented to cover the full price of the agreed-upon consideration at least 60 business days prior to the date of the expedition, failing which the expedition will be canceled without any right to a refund for THE CUSTOMER.
THE CUSTOMER will not be entitled to a refund for cancellation of the expedition at any time, regardless of whether the cancellation occurs more or less than 60 days in advance. However, THE CUSTOMER will have the right to transfer the amount paid to a third party who wishes to go on the expedition or use it as a deposit toward another Akampa expedition, provided that the cancellation is made more than 60 days in advance. This credit will be valid for 6 months from the date of the trip. In the event that THE CUSTOMER cancels within 60 days prior to the expedition, the amount paid will not be transferable or refundable under any circumstances.
Given that, in preparation for the expedition, AKAMPA must carry out various arrangements with third parties—including, but not limited to, payments for equipment, tour guides, transportation, and meal preparation— THE CUSTOMER shall not be entitled to any refund if, due to force majeure, they are unable to attend the expedition; AKAMPA shall bear no liability in such cases and will comply with the provisions of the relevant authorities.
When, due to force majeure, THE CUSTOMER is unable to attend the expedition, THE CUSTOMER shall have the right to transfer the expedition reservation to a third party up to 24 hours before the expedition begins. Said third party, under their strict responsibility, is not insured and assumes sole responsibility.
Since some expeditions require a minimum number of participants, AKAMPA reserves the right to cancel the expedition if this minimum is not met, in which case THE CUSTOMER shall be entitled to a full refund, which will be issued within 30 calendar days.
THE CUSTOMER will receive the corresponding refund via the selected payment methods or any other method provided to facilitate the refund.
FINANCIAL INFORMATION, INSURANCE, AND AUTHORIZATION FOR PAYMENT
THE CUSTOMER acknowledges and agrees that they must provide personal and financial information to book expeditions, which will be handled in accordance with the privacy policy of akampa.mx
THE CUSTOMER agrees and acknowledges that it is solely and exclusively their responsibility to provide the correct and complete information used to register for the expedition; therefore, AKAMPA shall not be liable to the CUSTOMER or any third parties who may be affected by the provision of incorrect information to the detriment of the CUSTOMER. If the expedition reservation is made less than 20 days in advance, AKAMPA cannot guarantee that insurance coverage will be in place.
THE CUSTOMER authorizes AKAMPA to use the information provided to process the corresponding charges for the expedition reservation and confirmation in local currency via the payment methods provided by THE CUSTOMER, and AKAMPA shall not be liable for any loss resulting from the provision of incorrect information regarding payment methods.
AKAMPA reserves the right to charge the payment methods provided by THE CUSTOMER for any damages caused by THE CUSTOMER to the property or equipment of a third-party service provider while receiving services, provided such damages are duly substantiated with evidence from the third party. In this regard, THE CUSTOMER will receive notice of the situation and will have 72 hours to dispute, with proper evidence, the liability claimed—or to accept and pay for it—on the understanding that, failure to do so, THE CUSTOMER grants AKAMPA the right to collect the claimed damages so that they may be deposited into AKAMPA’s account, while reserving the right to proceed by taking appropriate legal action.
IMAGE USE
BY MAKING A RESERVATION, THE CUSTOMER agrees and grants AKAMPA an unlimited license to use any image or video taken and uploaded to AKAMPA’s platform or social media channels under the terms set forth in this agreement and the privacy policy of the akampa.mx website.
